CONDITIONS OF SALE
In these Conditions of Sale, the "Seller" is Wellington Welding Supplies Ltd of;
Cattedown Road, Cattedown, PLYMOUTH, Devon, PL4 OSW
Register No.821066 (ENGLAND)
and
the "Buyer" is the person, company or body placing an order with the Seller via the web site either directly or indirectly with intent to purchase goods and/or services described on the web site.
No variation in these terms will be permissible unless signed by a Director of the Seller.
How to order
You can order products displayed on this website
- by telephoning us
- by faxing or posting to us a completed copy of the Wellington Welding Supplies Ltd order form or,
- on-line via our secure server.
If you have placed your order on-line, we will quickly send you an e-mail to confirm that we have received your order. If you wish you can print this out so that you have a hard copy of your order details. The fact that you receive an automatic confirmation does not necessarily mean that we will be able to meet your order.
Prices
Our prices are shown on our web site. We try to make sure that the prices on our website are accurate but we will need to validate the price before we process your order. If we are unable to supply a particular item which you have ordered or if the correct price for an item is different from the price on your order, we will notify you as soon as we can after receiving your order. If this happens, you may cancel your order and we will refund you any money that you have paid.
All quotations given by the Seller (unless otherwise agreed in writing) are subject to withdrawal and alteration without notice and do not constitute an offer to supply goods. Goods supplied against order via the web site will be charged at the price and the date of despatch. Prices, unless shown in the checkout area of the web site, do not include the Cost of delivery and value-added tax which must be paid by the Buyer, unless stated otherwise.
Payment
You can pay by Visa or MasterCard credit card, by Delta debit card, by cheque or apply for a Customer Account (See below). To ensure that shopping on-line is secure, your credit/debit details will be encrypted and transmitted over a Secure Socket Layer (SSL) to minimise the possibility of someone being able to read your details as they are sent to us over the Internet. The prices displayed on are web site are in British Pounds Sterling and any orders received will be debited in British Pounds Sterling. In the case of orders received by the Seller from outside the UK, the exact exchange rate will be determined by your credit card supplier at the time the order is processed.
Customer Accounts
A Buyer may apply for a customer account by clicking on the "register" button above and completing fully the account application form. An account may or may not be opened at the discretion of the directors of the Seller. The Buyer agrees to be bound by any conditions relating to an account. The Sellers decision is final.
Accounts in respect of goods supplied are due for payment by the Buyer on or before the last day of the month following that of delivery. The Seller reserves the right at any time and without prior notice to suspend deliveries to the Buyer in the event of any account of the Buyer with the Seller remaining unpaid after the time specified above. The Seller reserves the right to charge interest on overdue accounts at the rate of 2% above National Westminster Bank Base Rate per day.
Delivery
Delivery of the goods will be arranged by ourselves using either our own delivery methods or using an outside contractor. You will be notified of the delivery cost before you submit your credit card details. If your delivery address is outside the UK and you order in any other way other than on-line, please contact us for details of the delivery charge.
All goods received from the Sellers via a carrier must be signed for as "unexamined" and shortages and defects must be advised within 3 days of delivery (or collection). The Sellers shall not be responsible for any consequential loss or charge other than of replacing the defective unused goods.
Returns
We believe that you will be delighted with your product but there may be occasions where you feel it necessary to return an item to the Seller. We aim to keep the process as simple as possible. You can return your order in its original condition to;

within 30 working days of the date on which you receive it. The Buyer will be responsible for the item or items until they reach the Seller. For the protection of the Seller, the Buyer suggests a secure delivery method is used that requires a signature upon delivery. If the Buyer returns an item to the Seller which is faulty, or that the Buyer did not order or for any other reason which is the fault of the Seller, the Seller will pay you the cost of the return postage. In such circumstances, please telephone or e-mail the Seller in the first instance and we will let you know how you should send the item to us. All refunds will be paid within 30 days of cancellation of order.
Complaints Procedure
If in the unlikely event that you have a particular complaint then please click the 'contact us' link above and use our on-line response form. Please use the comments box to indicate any details of your complaint. At Wellington Welding Supplies Ltd we welcome any feedback so please use the form to inform us of any services you feel we need to improve. We acknowledge all complaints within 5 working days and will provide you with a likely timescale for resolving the dispute. The Buyer will be kept informed of the progress of any disputes. All complaints will be dealt with in the strictest of confidence. At Wellington Welding Supplies Ltd we believe in providing a complaints procedure which is effective and fair at all times.
Title of the goods
Property of the goods shall not pass to the Buyer unless payment of the purchase price has been made in full, and until such time;
(a) the Buyers must on request permit the Sellers or their agents to enter the Buyers premises to repossess the said goods and
(b) the Buyers hold the said goods on the fiduciary basis only on behalf of the Sellers and
(c) the Sellers will permit the Buyers to sell the said goods, but if the goods are sold the Buyers shall be under a fiduciary duty to account to the Sellers for the proceeds of the sale.
If the Buyer shall become insolvent or fail to make due payment in the time and manner specified by the Seller, then the Seller shall have the right to suspend or cancel deliveries and payment for all goods materials and services already supplied by the seller shall be come due immediately.
(a) An individual or firm shall be deemed to have become insolvent on the committing of any act of Bankruptcy or on having execution levied on his or its goods or on a Petition in Bankruptcy being presented against him or any partner in the firm.
(b) A Limited Liability Company shall be deemed to have become insolvent on the appointment of a Receiver or Manager on behalf of a Creditor, on having execution levied against its goods or on the passing of a resolution (other than for the purpose of amalgamation or reconstruction) for the winding up or on happening of any event which would entitle the Court to appoint a Receiver or Manager to make a Winding up Order.
No conditions or warranty is given or implied as to the life or wear of the goods whether they will be suitable for any particular purpose or use. The Buyers attention is drawn to the Caution Notice on the Sellers products as follows: "Welding may produce fumes and gasses hazardous to health. Avoid breathing these fumes and gasses. Use adequate ventilation. See W.H.A. Publication No.236". The Seller's goods should only be used in the manner and for the purpose for which they were intended.
Privacy Statement
The Seller is committed to protecting your privacy. Information that we collect about the Buyer will be used lawfully (in accordance with the Data Protection Act 1998) and according to the Which? Web Trader Code of Practice.
The Seller collect information about the Buyer for 2 reasons: firstly, to process the Buyer's order and second, to provide the Buyer with the best possible service.
The Seller will not e-mail the Buyer in the future unless you have given us your consent.
The Seller will give the Buyer the chance to refuse any marketing email from the Seller or from another trader in the future.
The type of information we will collect about The Buyer includes:
your name
address
phone number
email address
credit/debit card details
The Seller will never collect sensitive information about the Buyer without the Buyer's explicit consent. The information the Seller holds will be accurate and up to date. The Buyer can check the information that the Seller holds about the Buyer by emailing us. If Buyer finds any inaccuracies the Seller will delete or correct them promptly.
The personal information which the Seller holds will be held securely in accordance with the Seller's internal security policy and the law and the Which? Web Trader Code.
If the Seller intends to transfer your information outside the EEA (European Economic Area) the Seller will always obtain the Buyer's consent first.
The Seller may use technology to track the patterns of behaviour of visitors to the site. This can include using temporary cookies which would be stored on the Buyer's browser. The Buyer can
usually modify his/her browser to prevent this happening. The information collected in this way can be used to identify the Buyer's preferences when returning to the site.

These Conditions and any contract made subject thereto shall be subject to and constructed in accordance with the English Law.

In opening an account with our company, you confirm by your signature that you have read, understood and agree to the Conditions of Sale above, and that they should apply to the contract(s) between us.
WEEE REGULATIONS
The Waste Electrical and Electronic Equipment (WEEE) Directive is now U K law. The
legislation aims to make producers pay for the collection, treatment and recovery
of waste electrical equipment. The regulations also mean that suppliers of equipment
like high street shops and internet retailers must allow consumers to return their
waste equipment free of charge.
The amount of WEEE we throw away is increasing by around 5% each year, making it
the fastest growing waste stream in the UK.
- Much of the UK’s WEEE ends up in landfill, where the lead and other toxins it contains
can cause soil and water contamination. This can have a harmful effect on natural
habitat, wildlife and also human health.
- Many electrical items that we throw away can be repaired or recycled. Recycling
items helps to save our natural finite resources and also reduces the environmental
and health risks associated with sending electrical goods to landfill.
Distributors of new Electric and Electronic Equipment (EEE) have a part to play
in reducing the amount of WEEE going into landfill sites.
Wellington Welding Supplies Ltd are obliged under these regulations to offer our
customers free take-back of their WEEE on a like-for-like basis when you buy from
us a new Electrical or Electronic product.
For example, if a customer bought a new single phase Mig welder from us we would
accept their old single phase Mig welder back and prevent it going into a landfill
site by disposing of it safely. Customers must return their WEEE item to us within
28 days of purchasing their new item.
Under the WEEE Regulations, all new electrical goods should now be marked with the
crossed-out wheeled bin symbol shown below:
Goods are marked with this symbol to show that they were produced after 13th August
2005, and should be disposed of separately from normal household waste so that they
can be recycled.
